Terms of Use of the “Businesses” Service
This document is an official legal notice (disclaimer) and governs the terms of use of the AutoBoom automotive business directory, as well as the company data management service provided through the website.
This document defines the conditions for access to the Service, the procedure for using its functionality, the rules for posting and processing business information, payment terms (if paid features are available), limitations of liability, and other rules for using the platform.
Use of the Service and/or confirmation of acceptance of these Terms by checking the corresponding box indicates the User’s full and unconditional agreement with the provisions of this document.
For convenience, the text is written in the masculine gender; however, all wording applies equally to persons of any gender.
These Terms of Use constitute a legally binding agreement between you (hereinafter referred to as the “User”) and the owner of the AutoBoom platform (hereinafter referred to as the “Company,” “We,” or the “Service”).
By checking the box “I accept the Terms of Use” and/or by using the Service, you confirm that you:
- have read these Terms;
- understand their content;
- agree to comply with them in full.
If you do not agree with these Terms, you must not use the Service.
1. Description of the Service
The Service provides online tools for independent management of information about the User’s business размещed in the AutoBoom directory, including editing the company profile, contact details, descriptions, images, and other information.
2. Registration and Access
2.1. Use of the Service requires the creation of an account.
2.2. The User undertakes to provide accurate and up-to-date information.
2.3. The User bears full responsibility for safeguarding login credentials and for all actions performed through their account.
3. User Content and Responsibility
3.1. The User independently adds and modifies information about their business.
3.2. The User bears full and exclusive responsibility for all posted content, including but not limited to:
- phone numbers;
- email addresses;
- links to websites, social networks, and messengers;
- service descriptions;
- images and logos.
3.3. The User warrants that the posted information:
- is accurate;
- does not infringe the rights of third parties;
- complies with applicable law.
3.4. The Company does not verify and is not obliged to verify the accuracy of contact details or other information added by the User.
3.5. All claims by third parties related to information posted by the User shall be resolved by the User independently.
4. Listing in the Directory and Right of Refusal
4.1. The Company reserves the right, at its sole discretion, to:
- refuse to list a business profile in the AutoBoom directory;
- refuse to publish or display any User data;
- remove information already posted;
- restrict or terminate access to the Service in whole or in part.
4.2. Such actions may be taken without explanation and without prior notice to the User.
4.3. The User acknowledges and agrees that listing information in the directory is not an obligation of the Company and is carried out at its discretion.
5. Acceptable Use
The User undertakes not to use the Service for:
- posting illegal, misleading, or harmful information;
- infringing intellectual property rights;
- sending spam;
- interfering with the operation of the Service;
- any other actions that violate the law or these Terms.
6. Paid Features
6.1. Some features of the Service may be provided on a paid basis.
6.2. Payment terms and pricing are published separately and form an integral part of these Terms.
6.3. The User is obliged to make timely payments in accordance with the selected plan.
7. Intellectual Property
7.1. All rights to the software components of the Service, its interface, design, and functionality belong to the Company.
7.2. The User retains rights to their content but grants the Company the right to use it within the operation of the directory and the Service.
8. Privacy and Data
The processing of personal data is carried out in accordance with the Privacy Policy published on the Service’s website and forming an integral part of these Terms.
9. Limitation of Liability
9.1. The Service is provided “as is.”
9.2. The Company does not guarantee uninterrupted or error-free operation of the Service.
9.3. The Company shall not be liable for:
- actions of Users;
- the content they post;
- losses arising from the use or inability to use the Service;
- consequences of refusal to list or removal of a profile.
10. Termination of Access
The Company has the right to suspend or terminate the User’s access to the Service in the event of a violation of these Terms or legal requirements, as well as in the cases specified in Section 4 of these Terms.
11. Amendments to the Terms
The Company may amend these Terms at any time. The current version is published on the website.
Continued use of the Service after amendments are made constitutes the User’s acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Israel.
All disputes shall be subject to the jurisdiction of the competent courts of Israel.
